JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 Petitioner seeks bail in anticipation of his arrest in connection with Harsidhi P.S. Case No. 311 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

As per FIR there is recovery of 5 litres of liquor from the poultry firm of the petitioner.

Submission of learned counsel for the petitioner is that there is no such recovery from his firm and he has no criminal antecedent and he has falsely been implicated in this case.

Heard learned APP, who has opposed the prayer for anticipatory bail.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to

Patna High Court CR. MISC. No.84117 of 2019(2) dt.18-12-2019 2/2 surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
