====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-02-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for offence under Sections 126(2)/115(2)/108/3(5) of the B.N.S.
3. As per F.I.R., due to land dispute, the mother-in-law of the informant namely, Minara Khatun had earlier filed a case against the accused persons and thereafter, accused persons were putting pressure on mother-in-law of informant not to pursue the case. It is alleged that on 15.07.2024, all the accused persons including petitioner allegedly entered the house of the victim, used abusive language, assaulted her and pressurized her to withdraw the case and on protest, she was again assaulted. It is next alleged that when informant reached home, her motherin-law informed her that the accused persons abused and
Patna High Court CR. MISC. No.4730 of 2026(2) dt.16-02-2026 2/3 insulted her for withdrawing the case. Fed up with this, her mother-in-law consumed poison and was taken to the hospital where she was declared dead.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner has been made accused in this case only because of admitted land dispute between the parties. Petitioner is wife of coaccused Md. Jamir Alam who has already been allowed bail by this Court vide order passed in Cr.Mis.No. 41876/2025. There is no allegation of active or direct act against this petitioner, which led the deceased to commit suicide. As a matter of fact, the deceased herself committed suicide by consuming poison. As per FSL report, ENDRIN was detected in examination of viscera. Petitioner is in custody since 15.9.2025. Charge-sheet has been submitted.
5. Learned A.P.P. for the State opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - III, Katihar in connection with
