The petitioner is apprehending his arrest in connection with Complaint Case No.255(C ) of 2019 dated 31.5.2019 registered for offences punishable under Sections 498A/34 of the Indian Penal Code.

Allegation against the petitioner is of demand of Rs.04 lac and for that subjecting the informant to cruelty. Submission of the learned counsel for the petitioner is that the allegation is false and he is ready to keep her and as she was not ready to reside as such a divorce petition has been filed by him.

Heard learned A.P.P. , who has opposed the prayer for bail stating that conduct of the petitioner is self-contradictory. Having heard both sides and in view of submissions as

No.203 of 2020(2) dt.23-01-2020 2/2 made above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, this application is disposed of with a direction to the petitioner that the petitioner shall approach the complainant in this case and for that if he so desires he may take help of the local police station for which he will approach the S.H.O. of Masaurhi Police Station, who will either himself accompany the petitioner or he will dispute any official to accompany him to the house of the complainant and once the same was materialized, the petitioner shall move before the court below along with the O.P.no.2 (complainant) who will consider their submissions and considering the submissions will pass appropriate order.

It is also made clear that the S.H.O., Masaurhi will also submit a report regarding the above direction to the concerned court below.

With the aforesaid direction, this application is disposed of.
