JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-01-2021 Heard the learned counsel for the petitioner and Mrs. Anita Kumari Singh, the learned A.P.P. for the State. The petitioner seeks regular bail in connection with Siwan Muffasil P.S. Case No. 153 of 2019 for the offence registered under Sections 498(A), 304(B), 201/34 of the Indian Penal Code.
The allegation is regarding the petitioner herein, who happens to be the husband of the deceased victim lady, having killed her on account of non-fulfillment of the demand for dowry.
The learned counsel for the petitioner has submitted that the petitioner is innocent, has been falsely implicated in the present case and he is having a clean antecedent. It is further submitted that the petitioner is languishing in custody since

Per contra, the learned counsel for the State has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available on record as also those available in the case dairy, I find that a prima facie case is definitely made out as against the petitioner herein of having murdered his wife, hence I do not find any merit in the present petition, thus the present petition stands dismissed, however, with a direction to the learned trial court to expedite the trial.
