This application is for grant of regular bail in connection with Pirbahore P.S.case No.342 of 2019 for the offences under Sections 302/34 of the Indian Penal Code. As per FIR, petitioners are said to have stabbed the deceased causing his death.

Submission of the learned counsel for the petitioners is that as a matter of fact the deceased was inimical term with the owner of the chicken shop and they have killed the deceased and falsely implicated the petitioners. There is no eye witness of the occurrence.

Heard learned A.P.P. who has opposed the prayer

Patna High Court CR. MISC. No.84352 of 2019(3) dt.19-02-2020 2/2 for bail on the ground that the some witnesses have taken the name of the petitioners who have killed the deceased and they appear to be eye witness of the occurrence. Postmortem report also shows that there are several stab injury on the person of the deceased..

Having heard both sides and considering the same,I am not inclined to grant bail to the petitioner . Accordingly, this application is dismissed.
