The petitioner is languishing in custody since 30.9.2019 in a case registered for the offences punishable under Sections 147,148,149,341,342,324,325,326,307,332,333,216,224,225,33 7,338,353,186 and 504 of the I.P.C. and Sections 25(1-B) a, 26 and 27 of the Arms Act.

The prosecution case as per the Fardbeyan of ASI Nawal Kishore Singh, recorded by SHO, Manihari Police Station is to the effect that on 29.9.2019, on secret informant that the wanted accusedMd. Jafar in Kadwa P.S. Case No. 130 of 2019, is taking shelter in Narayanpur village due to rain, raid was conducted when the mob assaulted the informant and other police officer, as a result the informant received injury. It is submitted by learned counsel for the petitioner that

Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the accusation is of making assault to the police personnel and causing injury. Considering the accusation being omnibus and genera, investigation being concluded, statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Katihar in connection with Manihari P.S.
