2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 352, 351(2), 3(5) and 303(2) of the B.N.S..

3. As per prosecution case, informant, namely Mahesh Paswan, alleged that on 05.06.2025 at about 8 o'clock, after Dwar Puja, all the family members of the informant were going to perform the ritual of Barnet, in the meantime, 25 to 30 unknown persons attacked them and looted jewelleries and cash and also assaulted them. Through the help of local people, they came to know that all the F.I.R. named accused persons, including this petitioner and 20 to 25 unknown persons were involved in the alleged occurrence.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Informant has not disclosed the source of information as to who disclosed the name of this petitioner, which itself makes the entire prosecution case doubtful. Allegations are general and omnibus. No looted article were recovered from possession of this petitioner. Similarly situated co-accused persons have already been granted the privilege of anticipatory bail by this Hon'ble Court vide order dated 18.11.2025 passed in Cr. Misc. No. 73161 of 2025. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, the fact that no looted articles were recovered from possession of the petitioner, claim based on parity and clean antecedents, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs.
