JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This is an application for grant of anticipatory bail in connection with Gaighat P.S. Case No.286 of 2019, disclosing offences under Sections 272, 273 and 414, 120B of the Indian Penal Code and Sections 30(a) 38 and 41 of the Bihar Prohibition and Excise Act, 2016.
As per F.I.R. there is recovery of 36 liters of liquor from the house of the petitioner.
Submission of the learned counsel for the petitioner is that nothing has been recovered from his house, rather his house is in dilapidated condition. Petitioner has no criminal antecedent.

Having heard both sides, in view of the allegation, I am not inclined to grant privilege of anticipatory bail to the
Patna High Court CR. MISC. No.84289 of 2019(2) dt.18-12-2019 2/2 petitioner. However, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which shall be considered by the learned trial court, the same shall be considered on the basis of the materials available against him, and if possible to be disposed of on the same day.
