The petitioner seeks modification of the order dated 13.03.2019 passed by a Bench of this Court in Cr. Misc. No. 5541 of 2019.

By the aforesaid order, the petitioner was granted anticipatory bail but subject to his surrender before the court below within a period of six weeks of the passing of the order.

Learned counsel for the petitioner submits that he could not surrender in time for the reason that he was unfit for quite a long time and due to the losses in

Patna High Court CR. MISC. No.84987 of 2019(3) dt.01-07-2020 2/2 the business, he could not deposit the amount as directed. Now, the petitioner has arranged the money and is ready to deposit the same before the court below. The provisional bail of the petitioner, therefore, is extended for a further period of six weeks from today within which time, the amount as directed should be deposited before the court below. The court below, on being satisfied that money has been deposited and the order dated 13.03.2019 has been complied with, shall confirm the provisional bail granted to the petitioner. In case the money is not paid within the time allowed by this Court, it would be open for the informant/opposite party no. 2 to approach the court below and seek cancellation of the provisional bail of the petitioner. The court below, in that event, shall immediately send notice to the petitioner and shall proceed for cancellation of his bail.

The order stands modified to the extent indicated above.
