The petitioner seeks bail in a case registered for the offence punishable under Section 376 of the Indian Penal Code and Section 6/8 of the POCSO Act.

While the daughter of the informant was regressing from his jute field, the petitioner caught hold her from the back, dragged the cloth in her mouth and committed rape against her. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case due to previous enmity and dirty village politics. The doctor, who has examined the victim, has reported no internal or external injury on her private part and also no spermatozoa either dead or alive found on her private

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned 1stAdditional Sessions Judge-cum-Special Judge, Araria in connection with Special (POCSO) Case No.31 of 2019, arising out of Palasi P.S. Case No.192 of 2019.
