JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 This is an application for grant of anticipatory bail in connection with Thawe P. S. Case No. 155 of 2019 disclosing offences under Sections 341, 323, 324, 307, 379, 504, 506/34of the Indian Penal Code.

As per F.I.R. while the informant was engaged in the centering work of his house, petitioners along with several other accused persons came and started the informant. There is specific allegation against petitioner no.1 of assault by Farsa, causing injury to him. There is allegation against petitioner no.2 that he assaulted his niece by rod, causing injury. Submission of the learned counsel for the petitioners is that there is case and counter case between the parties with

Patna High Court CR. MISC. No.84409 of 2019(2) dt.19-12-2019 2/2 respect to same occurrence and as it appears that there is free fighting with respect to land dispute. The impugned order disclosed that the informant has no injury and niece of the informant has also not received any injury.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Gopalganj, in connection with Thawe P.
