JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kishanganj P.S. Case No. 95 of 2019 (G.R. No. 318 of 2019) for the offenses under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and later on Section 302 IPC was added. In the instant case case diary was called for. Initially the case was registered under Section 307 IPC but later on when the injured died after 33 days section 302 IPC was added. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 11.06.2019. There is no specific overt act alleged against this petitioner which has not been disputed by learned

Considering the aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 50,000/-(Fifty Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 95 of 2019 (G.R. No. 318 of 2019).
