JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2019 Petitioner seeks bail in anticipation of his arrest in connection with Paliganj P.S. Case No. 107 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 436 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 27 of the Arms Act.
As per FIR petitioner and other accused persons set the house of the informant on fire and when villagers came there they made indiscriminate firing.
Submission of learned counsel for the petitioner is that allegation is general and omnibus and no specific allegation has been attributed against him and he has no criminal antecedent.
Heard learned APP, who has opposed the prayer for anticipatory bail.
Patna High Court CR. MISC. No.84869 of 2019(2) dt.20-12-2019 2/2 In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and prays for regular bail, the same shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
