JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-03-2020 Petitioner seeks bail in connection with Special Case No. 140 of 2019, arising out of Bihta P.S.Case No. 963 of 2019 registered for the offences punishable under Sections 8,20 and 22 of N.D.P.S Act.

Allegation is of recovery of 6-1/2 kg. of ganja from the vehicle and petitioner was arrested there. Submission of learned counsel for the petitioner is that he was only a loader and there is no recovery from his possession and the seized ganja is less than commercial quantity and he is in custody for more than four months and charge sheet has been submitted.

Heard learned APP also.

In the facts and circumstances, as stated above, let petitioner, named above, be released on bail on furnishing bail

Patna High Court CR. MISC. No.1098 of 2020(4) dt.20-03-2020 2/2 bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, Patna, in connection with Special Case No. 140 of 2019, arising out of Bihta P.S.Case No. 963 of 2019.
