Petitioner is in custody in connection with Sessions Trial No. 876 of 2018 arising out of Kahalgaon P.S. Case No. 68 of 2018 for the offence under sections 395/397 of the Indian Penal Code.

Learned counsel for the petitioner would submit that except criminal antecedents there is no material against this petitioner. He further submits that petitioner was not named in the FIR. His name surfaced on the basis confessional statement of Anupam Kumar Singh.

The petitioner is in custody since 03.07.2018. Considering the fact that petitioner was not named in the FIR and he has remained in custody for one year and eleven
