The petitioner seeks bail in a case registered for the offence punishable under Sections 21, 22(b) of the NDPS Act, 1985.

Prosecution case is that on 01.10.2019 at about 2.45PM informant received information that at Hata (boundary) of Karam Turha in the Bichla Tola where overcrowded has been arrived old Dealer of Heroin Drugs Udhary Rai, petitioner accused went for selling Heroin drugs. He informed Senior Officer and he along with Sri Vikas Kumar, Circle Officer, Brahampur and police party reached at the P.O. and found that seeing police ousted from boundary and tried to flee away but caught. On inquiry he told his name as Udhari Ray @ Sandeep

Patna High Court CR. MISC. No.85503 of 2019(3) dt.18-03-2020 2/2 Singh petitioner. In presence of Sri Vikas Kumar and 2 independent witnesses namely Krishna Murari Singh and 2 Deenbandhu Singh he searched and recovered 14 small size sachets and 10 gram wrapped in paper containing Heroin drugs like substance from the possession of the petitioner. Accordingly, seizure list was prepared.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that charge has been framed and one witness has been examined.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with NDPS Case No. 14 of 2019 arising out of Brahmpur P.S. Case No. 429 of 2019 pending before the court of the learned District and Sessions Judge-cumSpecial Court, NDPS, Buxar. (Anjani Kumar Sharan, J) devendra/- U T
