JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-03-2020 The petitioner seeks regular bail in connection with Amas P.S. Case No. 150 of 2019, corresponding to NDPS Case No. 3 of 2019/ 53 of 2019 registered for offences punishable under Section 8/20(b)(ii)(c)/29 of the Indian Penal Code. Allegation is of recovery of 120 kilograms of ganja from a vehicle and two accused persons were apprehended and they disclosed the name of petitioner and one Rahul Kumar as the person, for whom, they are carrying the seized ganja. It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner and he has been made accused only on the basis of confession of co-accused and except that there is nothing against the petitioner and other similarly situated co-accused, namely, Rahul Kumar has already been enlarged on bail by a coordinate Bench of this

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -IV, Gaya, in connection with Amas P.S. Case No. 150 of 2019, corresponding to NDPS Case No. 3 of 2019/ 53 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
