ANJANA MISHRA ORAL ORDER 19-12-2019 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Nasariganj P.S. Case No.234 of 2018 registered for the offence punishable under Sections 153A, 295A, 429 of the Indian Penal Code and Section 11 of the Prevention of Animal Cruelty Act.
Learned counsel for the petitioners submits that there has been no recovery of any illegal articles nor from the possession of the present petitioners, rather they have been named by the Choukidar on some hearsay of co-villagers who have not been named in the F.I.R. It is further submitted that
Patna High Court CR. MISC. No.84341 of 2019(2) dt.19-12-2019 2/2 other similarly situated persons have since been extended the privilege of bail in Cr.Misc. No.29736 of 2019, vide order dated 07.05.2019 and Cr.Misc. No.37791 of 2019, vide order dated 25.06.2019.
In view of the aforementioned facts and circumstances, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas, in connection with Nasariganj P.S. Case No.234 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
