Mr. Shyameshwar Dayal, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-06-2020 Heard Mr. Satya Prakash Parasar, learned counsel for the petitioners and Mr. Shyameshwar Dayal, learned APP for the State.

The petitioners, who are father and son amongst themselves, seek bail in anticipation of their arrest in connection with Laxmipur P.S. Case No. 281 of 2019 dated 30.07.2019 instituted for the offences under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.

The petitioners are alleged to have assaulted the informant on his head leading to injuries on his person.

It appears from the impugned order that a lacerated wound has been found on the parietal region

It has been urged on behalf of the petitioners that till date, the nature of injury has not been opined. Apart from this, admittedly, there is a dispute with respect to boundary wall.

Considering the nature of accusation, the background facts and that till date, no opinion regarding the nature of injury could be obtained, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Ist Class, Jamui in connection with Laxmipur P.S. Case No. 281 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
