JUSTICE MADHURESH PRASAD ORAL ORDER 17-01-2020 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 392 of the IPC.

Motorcycle and mobile phone of the informant are alleged to have been snatched while he was moving along with his maternal uncle.

Petitioner's name has been disclosed by co-accused Pawan Kumar. The said accused has been granted bail in Cr. Misc.no. 65323/2019.

Counsel for the petitioner submits that other than confessional statement of the petitioner, there is nothing to connect the petitioner with the said crime. Till date he has not been put on test identification parade and no recovery has been made to suggest his implication.

Patna High Court CR. MISC. No.86225 of 2019(2) dt.17-01-2020 2/2 Petitioner is accused in Rikhiya P.S. Case no. 171/2018 in which he has already been granted bail by Jharkhand High court. Petitioner is in custody since 18.10.2019. Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Chandan(Anandpur) P.S. Case no. 115/2018 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
