JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 06-04-2022 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 901 of 2019 registered for offence punishable under section 498(A) of the Indian Penal Code and section 4 of the Dowry Prohibition Act.

It is a case of matrimonial dispute. Opposite party no. 2 is wife of the petitioner. She has levelled allegation that after marriage, when she went to her matrimonial house, the accused

Patna High Court CR. MISC. No.249 of 2020(4) dt.06-04-2022 2/2 persons tortured and demanded a motor cycle and LCD T.V.. Lastly, they ousted her from matrimonial house. The petitioner was ready to keep her wife with full dignity and honour. As such, the matter was referred to the District Mediation Centre. A report thereof dated 19.01.2022 has been annexed with the record as flag 'P', which shows that the petitioner was ready to keep the victim on some conditions, but the victim refused to go to her matrimonial house and due to that reason, the mediation failed.

Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Begusarai in connection with Complaint Case No. 901 of 2019, subject to condition as laid down under section 438(2) Cr.
