JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-12-2019 This is an application for grant of anticipatory bail in connection with Special (POCSO) Case No. 197 of 2019 arising out of Paliganj P. S. Case No. 381 of 2019, disclosing offences under Section 354B of IPC and Section 4/8 of POCSO Act. As per F.I.R. petitioner is said to have tried to outrage the modesty of the daughter of informant while she has gone to attend the call of nature.

Submission of the learned counsel for the petitioner is that the informant has taken some cash from the father of the petitioner, which he demanded, hence, he has falsely been implicated in this case, having no criminal antecedent. Heard learned A.P.P. also, who opposed the prayer for anticipatory bail on the ground that girl is minor. There is also application of POCSO Act.

Patna High Court CR. MISC. No.84287 of 2019(2) dt.18-12-2019 2/2 Having heard both sides, in view of the allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit, without being prejudiced by order of this Court.
