This is an application for grant of anticipatory bail in connection with Amdabad PS case no. 39 of 2019 registered for the offences punishable under Section 392 of Indian Penal Code.

The allegation is regarding a sum of Rs. 3.36 lacs having been snatched from the informant by three unknown miscreants.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case merely on the basis of the fact that the petitioner was found roaming nearby the Bank. It is further submitted that the petitioner is having a clean antecedent and is ready to abide by such

Having regard to the facts and circumstances of the case, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail. Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Amdabad PS case no. 39 of 2019, subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure. It is further directed that the petitioner shall mark his presence before the officer-in-charge of the concerned police station at 10.

30 am on every Monday, starting from the day he is released on bail, and in case of failure to do so on two consecutive occasions, the present privilege of bail shall stand cancelled automatically and the petitioner shall be taken into custody forthwith.
