Petitioners, apprehend their arrest registered for the offences punishable under Sections 33, 41 & 42 of Indian Forest Act and Sections 27, 29, 50 & 51 of Wild Life Protection Act.

Informant is the Forester, Prabhakar Kumar

Patna High Court CR. MISC. No.84469 of 2019(2) dt.19-12-2019 2/3 Singh, who in his written complaint has alleged that on 18.01.2016 at about 3:45 A.M. while he was on patrolling duty he heard sound of axing down the tree and when he reached the said place he saw miscreants fleeing away and they escaped taking advantage of darkness and found one green Sisam tree was cut into three pieces which were seized. It is further alleged that the accused were identified in the light of torch.

It has been submitted on behalf of the petitioners that they are innocent and have been falsely been implicated in this case only on the basis of suspicion and personal grudge. They have no criminal antecedent and are resident of adjacent to forest area.

Considering the facts and circumstances of the present case, let petitioners, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on pre-arrest bail on furnishing bail bond of Rs. 20,000/- (twenty thousand only) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-3rd, Bagaha, District- West Champaran, in connection with Tr. No. 2260 of 2019 arising out of I.F. Case No. 06 of 2016,
