The petitioners apprehend their arrest in connection with Kumarkhand P.S. Case No. 159 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 337, 427, 354(B), 379, 307, 504, 506/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that in all there was allegation against 22 named person, including the petitioners. It is, however, submitted that so far as the present petitioners are concerned, there is specific allegation against the
Patna High Court CR. MISC. No.2056 of 2020(2) dt.27-02-2020 2/2 petitioners to assault the informant with iron rod and by bricks. Learned counsel for the petitioners further submits that the injury (Annexure-2) shows that all the injuries are simple in nature. He further submits that similarly situated co-accused has been granted anticipatory bail by this Co-ordinate Bench of this Court vide order dated 24.01.2020 passed in Cr. Misc. No.73954 of 2019. He further submits that there is case and counter case and there is land dispute between the parties. In the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Madhepura in connection with Kumarkhand P.S. Case No. 159 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
