Petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Submission is that recovery of foreign liquor is alleged from the house of co-accused. Petitioner was standing nearby the motorcycle of that accused, hence, was suspected that he was also involved in the dealing. Petitioner has got no criminal antecedent. He is in custody since 14.11.2019. Investigation of the case is already complete. Considering the fact that there is no substantial material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/-

Patna High Court CR. MISC. No.525 of 2020(2) dt.16-01-2020 2/2 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No.10063 of 2019, arising out of Mehandiganj P.S.Case No.204 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
