The petitioner seeks regular bail in connection with Bishanpur P.S. Case No. 72 of 2019 for the offence punishable under Sections 392, 34 of the Indian Penal Code. The allegation is regarding unknown miscreants having snatched a sum of Rs.1,03,025/-, a mobile and a gold ring from the informant, whereafter the accused persons are said to have fled away.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that neither any test identification parade has been held so as to connect the petitioner with the alleged crime nor any recovery has been made from the petitioner as far as the
Patna High Court CR. MISC. No.87491 of 2019(3) dt.20-01-2020 2/2 looted articles are concerned. Lastly, it is submitted that the petitioner is languishing in custody since 07.09.2019. Having regard to the facts and circumstances of the case, considering the submissions advanced by the learned counsel for the petitioner coupled with the fact that no T.I. Parade has been held so as to connect the petitioner with the alleged occurrence as well as no looted articles have been recovered from the possession of the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VII, Darbhanga in connection with Bishanpur P.S. Case No. 72 of 2019.
