The petitioner seeks bail in connection with Barhara (Krishnagarh) P.S. Case No.453 of 2018 registered under Sections 147, 148, 149, 323, 324, 325, 307, 447, 384, 427, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted by the learned counsel for the petitioner that the informant and the petitioner are co-villagers and there is ongoing land dispute between the parties. The allegation in the FIR is that the petitioner along with other accused came in the shop of the informant's brother and demanded Rs.10,000/- as extortion money at 12.00 O'clock in

Patna High Court CR. MISC. No.86664 of 2019(3) dt.19-03-2020 2/2 the night on 07.11.2018 is highly unbelievable and improbable. It is a matter of common knowledge that in villages, shops are not kept open till midnight. It is further contended that the petitioner has got no criminal antecedent and is languishing in jail since 24.10.2019.

Learned counsel for the State has opposed the prayer for grant of bail to the petitioner.

Considering the nature of offence and other attending circumstances, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Barhara (Krishnagarh) P.S. Case No.453 of 2018.
