JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 10-05-2022 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Complaint Case No. C-1708 of 2018, Trial No. 2396 of 2019, registered for offence punishable under sections 323, 504, 379, 341, 498-A of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act As per allegation, the marriage of the complainant Asha Devi was solemnized with the petitioner in the year 2014. The customary presents were given at the occasion of the marriage, but the accused persons insisted on their demand of dowry of a motor cycle and Rs. 1,00,000/- cash and lastly they

Patna High Court CR. MISC. No.85571 of 2019(9) dt.10-05-2022 2/2 ousted the victim from the matrimonial house for nonfulfillment of dowry demand. The learned counsel for the petitioner has submitted that the petitioner is ready to keep the victim with full dignity and honour.

The complainant was noticed for exploring the possibility of cordial resolution of the dispute, but she did not appear despite the fact that notice was received by her mother. Considering the above-mentioned facts and circumstances, let the petitioner above named, in the event of arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sadar, Motihari, East Champaran in connection with Complaint Case No. C-1708 of 2018, Trial No. 2396 of 2019, subject to condition as laid down under section 438(2) Cr. P.C.
