Mr.Bharat Bhushan ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 27-02-2026 Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners apprehend their arrest in connection with Madhubani P.S. Case No. 135 of 2025 registered for the offence under Sections 137(2), 140(1), 351(2), 3(5) of the BNS.

3. As per the prosecution case, the petitioners went to the informant's house and kidnapped her three years old minor child to grab her property. When the police raided the house of the petitioners, the petitioners have also assaulted the police party and the victim has also supported the allegation against the petitioners after recovery.

4. Considering the allegations levelled against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioner no. 01.

5. Accordingly, this application for anticipatory bail is dismissed with regard to petitioner no. 01.

6. The petitioner no. 01 is directed to surrender in the Court below within four weeks from today and pray for regular bail failing which the Superintendent of Police, Purnia will take all steps for arrest of the petitioner no. 1. If the petitioner no. 01 surrenders and prays for regular bail then the Court below will consider the same on its own merits without being prejudiced by the fact that anticipatory bail application of the petitioner no. 01 has been dismissed.

7. So far as petitioner no. 02 is concerned, there is general and omnibus allegation against her and considering the same, this application is allowed with regard to her.

8. Accordingly, let the petitioner no. 02, above named, in the event of her arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate,
