JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-01-2020 Petitioners seek bail in anticipation of their arrest in connection with Taraiya P.S. Case No. 328 of 2019 registered for the offences punishable under Sections 30(a) and 37(b) of Bihar Prohibition and Excise Act.

As per FIR there is recovery of 8 litres of liquor from the house of the petitioners.

Submission of learned counsel for the petitioners is that they were not present and they have falsely been implicated, having no criminal antecedent.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioners.

In view of above facts and circumstances, this

Patna High Court CR. MISC. No.85263 of 2019(2) dt.06-01-2020 2/2 application is disposed of with direction to the petitioners to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
