Petitioner seeks bail in a case registered for the offences punishable under Sections 30,30(a),38/41 of the Bihar Prohibition and Excise Act.

Submission is that the petitioner was not apprehended at the time of recovery of liquor. Petitioner has got no criminal antecedent.

Considering the fact that there is no substantial material against the petitioner for the purpose of grant of regular bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection

Patna High Court CR. MISC. No.86071 of 2019(2) dt.14-01-2020 2/2 with Panapur Police Station Case No.77 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below as well as petitioner shall not leave the country without permission of the Court and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
