The petitioner seeks bail in a case registered for the offence punishable under Sections 304B/34 of the Indian Penal Code.
The prosecution case is that the accused persons including the petitioner subjected the daughter of informant to cruelty and torture both mentally and physically due to nonfulfillment of dowry demand. It has been alleged that on 20.08.2019 the informant received information that her daughter has been killed, upon which he along with family members went there and found that his daughter is lying on wooden cot and also found the sign of rope around her neck. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He further submits that petitioner is in jail since 20.08.2019.
Considering the fact that the petitioner is the husband of the deceased, I am not inclined to enlarge the petitioner on bail. Accordingly, his payer for bail is rejected in connection with Kadwa P.S. Case No. 196 of 2019 pending before the court of the learned Chief Judicial Magistrate, Katihar. (Anjani Kumar Sharan, J) devendra/- U T
