2. The present writ petition has been filed directing the respondent to revise/fix the pay scale of the petitioner at the tune of Rs.2750/- to Rs. 4400/- with effect from 09.08.1999 on extension of A.C.P.

Learned counsel for the respondent submits that categorical stand has been taken by the respondent and the benefit of A.C.P. has been extended to the petitioner and in this regard the office order has been issued which is annexed as Anneuxre-B series, and in this view of the matter the admissible amount has also been intimated in the said letter issued vide Memo No.110 'Ka' dated 30.01.2021.

Learned counsel for the petitioner submits that the extension of A.C.P. has been made but difference of payment of arrears with effect from 11.01.1996 to 31.07.2002 and consequential benefit with regard to revision of pension, gratuity, earned leave amount etc. with effect from 01.08.2002 and benefit of sixth and seventh pay revision has not been figured in the said order.

In the light of the submissions made by the parties and the decision taken by the State by which the benefit of A.C.P. has been extended to the petitioner, the District Magistrate, Saran at Chapra, is directed to do the needful and take decision with regard to calculation of the entire payment under his supervision from the competent authority, i.e., B.D.O., Baniyapur, Saran, within three months from the date of production of a copy of this order.

6. With the above direction, this writ petition is disposed of.
