The petitioner seeks regular bail in connection with Barh PS case no. 413 of 2019 instituted for the offence punishable under Sections 506/34 of Indian Penal Code and sections 25(1-A), 25(1-AA), 35 of Arms Act.

The allegation is regarding a video having gone viral on social media, wherein two persons were shown with AK-47 firearm in their hands and one of them is stated to be the petitioner herein.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case, no recovery of the said firearm has been made from the possession of the petitioner and though the petitioner

Patna High Court CR. MISC. No.85088 of 2019(2) dt.20-12-2019 2/2 had been made accused in two other cases but he has been acquitted in the said two cases. It is further submitted that the petitioner is languishing in custody since 10.09.2019. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-1st Class, Barh, Patna in connection with Barh PS case no. 413 of 2019.
