====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-02-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Gopalpur P. S. Case No. 137 of 2023 registered for the offences punishable under Sections 363, 365 of the Indian Penal Code to which Sections 302, 201/34 of the IPC were added later on.

3. As per prosecution case, son of the informant went missing on 1.03.2023. F.I.R. was registered against the unknown.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Name of the petitioner transpired during investigation, in confessional statement of co-accused Richa Kumar and Ashish Kumar. Coaccused Ashish Kumar has already been granted bail by this

Patna High Court CR. MISC. No.3345 of 2026(2) dt.13-02-2026 2/2 court vide order dated 10.05.2024 passed in Cr. Misc. No. 6557 of 2024. Petitioner claims clean antecedent and is in custody since 27.09.2025.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of accusation, clean antecedent and period of custody, this bail application is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Gopalpur P. S. Case No. 137 of 2023.
