Heard learned counsel for the petitioner and learned APP for the State.
A report vide letter no. 16/2020 dated 06.03.2020 has been received from the learned Additional Distrtict & Sessions Judge-Xth, Kaimur at Bhabhua. It is stated in the letter that the case is fixed for argument and the same is in progress. Learned counsel for the petitioner has pointed out from the specific statements made in the application that in fact hearing of the case is pending since 22.04.2019 and the learned trial court has not concluded the same for over one year which is a matter of concern for the petitioner.
Patna High Court CR. MISC. No.84818 of 2019(3) dt.27-05-2020 2/2 Learned APP for the State submits that in the given facts and circumstances appropriate order and directions may be issued.
In the nature of the report of the learned trial court, this Court is not inclined to grant regular bail to the petitioner at this stage but the Court has certainly serious concern over the issue raised by learned counsel for the petitioner as regards pendency of the case on the point of argument for over one year. Let this matter be brought to the notice of the learned District and Sessions Judge, Kaimur at Bhabhua to ensure that the learned trial court must conclude the matter within a maximum period of four months from today and the hearing may be done through video conferencing subject to availability of the mechanism required for this purpose.
