The petitioner filed this writ petition to quash the notice issued under the signature of Circle Officer, Mohanpur that Plot No.2949 Khata No.167 area 46 decimals situated in Mauza Mohanpur has already been acquired by the Notification No.271 dated 08.07.1997.

Learned counsel for the petitioner submits that mother of the petitioner purchased the land in the year 1960 from Mahanth Rameshwar Dasji. No notice was issued to the petitioner in the land ceiling case initiated against Mahant

Patna High Court CWJC No.25788 of 2019(2) dt.10-01-2020 2/2 Rameshwar Dasji. Petitioner is a bonafide purchaser. After some argument, learned counsel for the petitioner seeks permission to withdraw this writ petition so that the petitioner may file reply to the notice as well as file fresh petition before the Collector under newly added Section 30 after deletion of Section 5 of the Bihar Land Reforms Act. Prayer is allowed. This writ petition is disposed of with the aforesaid direction.
