This is an application for grant of anticipatory bail in connection with Simari PS case no. 123 of 2016 registered for the offences punishable under Sections 467, 468, 471, 420, 401, 414, 201, 120(B) of Indian Penal Code.

The allegation is regarding the police having intercepted the Scorpio vehicle and from the same, one stolen Scorpio engine was recovered and three persons were arrested, who disclosed that engine had been bought for the vehicle of the petitioner.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and the vehicle in which the engine was to be fitted, does not belong to the petitioner. It is further submitted that the stolen engine has not

Patna High Court CR. MISC. No.86435 of 2019(2) dt.23-01-2020 2/2 been recovered from the possession of the petitioner and the vehicle, from which the same has been recovered, also does not belong to the petitioner.

Having regard to the facts and circumstances of the case, considering submissions made by the learned counsel for the petitioner coupled with the fact that neither the Scorpio vehicle which was apprehended by the police nor the stolen engine nor the vehicle which was to be fitted with the stolen engine, belongs to the petitioner, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail. Accordingly, the abovenamed petitioner, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga in connection with Simari PS case no. 123 of 2016 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
