2. The present petition has been preferred for the grant of following relief(s):
"(i) for setting aside an Order dated
2/6 26.06.2025 passed by the Circle Officer, Danapur by which prayer of the Petitioners for issuance of Rent Receipts, for 27.5 Dhur of land under Khata No.210 Plot No.1615 situated at Mauza - Danapur, Shahjadpur, P.S. No.21 within the District Patna, after proper deduction of Area either in running Jamabandi or newly created Jamabandi as per the boundary of the Sale Deeds has not been considered and the matter was disposed of in routine manner without giving finding over the issue involved for which the Circle Officer, Danapur was duty bound to pass proper Order.
(ii) for directing the Circle Officer to steps for cancellation of Jamabandi or correction of the Area of Jamabandi No.2168 which is running in the name of the mother of the Petitioner No.1 namely Smt. Usha Verma in which instead of granting Rent Receipts for the total area of 27.5 Dhurs (4.296 Decimals) only Rent Receipts is being issued with respect to 2.34 Decimals (14.98 Dhur) as the area of the land of
3/6 Jamabandi No.2168 has wrongly been deducted by the Revenue Authorities in order to give benefit to the land mafia.
(iii) for directing the Respondent Authorities especially the Circle Officer, Danapur to decide the grievances of the Petitioners as raised in their application dated 21.11.2023 by giving proper finding on the issue or objection made therein for which direction was issued on 29.03.2024 passed in C.W.J.C.
No.161 of 2024 but in a routine manner the Order dated 26.06.2025 has been passed by the Circle Officer, Danapur for which liberty has been granted by this Hon'ble Court to the Petitioners by Order dated 28.11.2025 passed in M.J.C. No.118 of 2025 to challenge the same.
(iv) for directing the Circle Officer, Danapur to examine the boundary of Registered Sale Deed dated 14.04.1987 for which Jamabandi No.2168 was created for 2.5 Katha of land (50 Dhurs) in which the Petitioners have only sold 22.5 Decimals of land to Smt. Aruna
4/6 Devi and Smt. Rambha Mishra as according to their boundaries in Sale Deeds on 12.03.2004 with specific boundary but instead of issuing Rent Receipts for remaining undisputed 27.5 Dhur of land only Rent Receipt is being issued for 14.98 Dhur and the area of land has wrongly been deducted of another portion in the running Jamabandi of the Petitioner.
(v) for directing the Respondent Authorities to take serious note by initiating an enquiry about the tampering of Revenue Record/Register-II by the Revenue Authorities in connivance with the land mafia in order to give benefit to them.
(vi) for grant of any other relief or reliefs in view of the facts and circumstances of the case for which the Petitioner is entitled too."
3. Pursuant to the last order, Mr. Dilip Kumar Gupta, the Circle Officer, Danapur, Patna is present in the Court.
4. The submission is that he has just joined the post on 07.07.2026 and has only rough knowledge of the present case.
5. Learned State counsel at the outset points out that
5/6 the order-sheet shows that the petitioner's mother sold the land to Rambha Mishra in whose favour Mutation Case No. 773 of 2019-20 was disposed of. She has not been made party respondent in the present case.
6. Learned counsel for the petitioner submits that the only prayer he wants is to consider their case and do the needful as the local land encroachers are eyeing on the land and in that background, they need a clear demarcation so that the family can live peacefully.
7. Pursuant to the last order, Rs. 10,000/- has been handed over to Mr. Abhishek, learned counsel for the petitioner who submits that in turn, he intends to gift flower pots of Rs.5000/- for the beautification of the office of the Circle Office, Danapur.
8. This Court expects that Mr. Abhishekh will be filing the receipt of the flower pots within a week.
9. Learned State counsel submits that a proper petition is preferred, it will be taken for consideration so that an appropriate reasoned order can be passed.
10. In that background, with the consent of the parties and since the Officer in question is himself present in the Court, the writ petition is disposed with liberty to the petitioner to
6/6 prefer an appropriate petition within a period of four weeks before the concerned respondent who shall be taking the same to its logical conclusion within a period of two months.
11. The receipt showing purchase of flower pots worth Rs.5000/- and donated to Circle office, Danapur shall be filed in the office.
