Petitioner's counsel submits that selection of respondent no.9 was not in accordance with law. Though petitioner was better candidate for being selected as Assistant technical under the scheme, respondent no.9 has been appointed ignoring his candidature.

Counsel for the State, on the other hand, draws attention of the court towards the result dated 02.03.2019.

Patna High Court CWJC No.1109 of 2020(2) dt.17-02-2020 2/2 Selection of the person under the scheme has been done by annexure 3 dated 02.03.2019 for one year and contractual engagement done in the said order is to come to an end on 31.03.2020.

This fact taken note of hereinabove, clearly shows that writ petition has been preferred belatedly. Contractual engagement made on 02.03.2019 for one year has been assailed by the petitioner on 17.01.2020.

This has to be viewed in the background of the fact that contractual engagement of respondent no.9 is likely to come to an end just within two months i.e. on 31.03.2020. Writ petition is dismissed.
