By this writ petition, the petitioner has callenged the order dated 20.08.2019 passed in BLT Case No. 1141 of 2016. The petitioner is a pre-emptor and he has no legal right. He wants to withdraw this writ application in view of the law laid down by the Supreme Court in the case of Punyadeo Sharma and others Vs Kamla Devi reported in 2022 (1) BLJ 434.

Petitioner is permitted to withdraw this writ petition

Patna High Court CWJC No.1757 of 2020(4) dt.17-11-2022 2/2 with the liberty to move the authorities for refund of the amount deposited by him for initiating the pre-emption proceedings, In case an application of refund is filed by the petitioner before the appropriate authority, the authority is duty bound to refund the amount within four weeks from the date of filing of the application.

With the aforesaid observation and direction, this application is disposed of.
