JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 This is an application for grant of anticipatory bail in connection with Kothi P. S. Case No. 40 of 20019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per F.I.R. on seeing the police party, petitioners leaving the motorcycle, succeeded in fleeing away from the spot. Police has recovered 50 liters of Mahua liquor from the motorcycle. It is alleged that villagers have identified the petitioners. It further appears that petitioners are accused in one more case also.

Submission of the learned counsel for the petitioners is that the identification is doubtful. They have falsely been

Heard learned A.P.P. also, who has opposed the anticipatory bail.

Having heard both sides, considering the allegation as well as antecedent, I am not inclined to grant privilege of anticipatory bail to the petitioners. However, if they surrenders and pray for regular bail, the same shall be considered on its own merit, without being prejudiced by this order. With the aforesaid, this application is dismissed.
