JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-10-2021 Heard Mr. Rajendra Lal Das, learned advocate for the petitioner and Mr. Shivendra Lal Das, learned counsel for Opposite Party No. 2. The State is represented by learned APP.
The petitioner seeks bail in anticipation of his arrest in connection with Madhubani Town P. S. Case No. 178 of 2018, dated 22.05.2018, instituted for the offences under Sections 448, 341, 323, 379, 427, 498A and 34 of the Indian Penal Code.
Both the learned counsel have informed this Court that the parties/spouses have settled their dispute
Patna High Court CR. MISC. No.1269 of 2020(3) dt.25-10-2021 2/2 and are living peacefully under the same roof as man and wife for the last one year. Thus, it has been submitted that no useful purpose would be served in keeping this application pending.
Considering the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P. S. Case No. 178 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
The application stands allowed.
