JUSTICE JITENDRA KUMAR ORAL ORDER 09-01-2025 This Criminal Revision Petition has been preferred against the impugned order dated 16.11.2019 passed by learned Additional District and Sessions Judge-VIth Rohtas at Sasaram whereby learned Appellate Court has held that the accused/appellant, Arun Kumar as juvenile and he has set aside the finding of learned J.J. Board that the accused Arun Kumar was major.
2. Learned counsel for the Opposite Party No.2, Arun Kumar filed certified copy of the judgment/order dated 17.10.2024, whereby learned J.J. Board has concluded the inquiry finding the accused persons including Arun Kumar, Opposite Party No.2 not guilty of the alleged offence. As such,
Patna High Court CR. REV. No.1553 of 2019(6) dt.09-01-2025 2/2 now there is no point to proceed with the present criminal revision.
3. The informant/petitioner has remedy to file appeal against the acquittal order dated 17.10.2024 passed by learned Juvenile Justice Board and in that appeal, he will have liberty to raise the juvenility.
4. Accordingly, the present petition is dismissed as having become infructuous with liberty to the petitioner/informant to raise the issue of juvenility of the petitioner which he may prefer against the acquittal order dated 17.10.2024 passed by learned Juvenile Justice Board.
