The petitioner seeks regular bail in connection with Kalyanpur P.S.Case No.156 of 2019 instituted for the offences punishable under Sections 399, 402 and 412 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. Petitioner and co-accused Vivek Singh were apprehend on suspicion that they were preparing to commit dacoity. From possession of the petitioner, a knife was recovered. Co-accused Vivek Singh has already been allowed regular bail by a coordinate Bench of this Court in Cr.Misc.No.74892 of 2019 dated 11.12.2019. Petitioner is in custody since 29.06.2019. Investigation of the case is already complete.

No. 87181 of 2019(2) dt.14-01-2020 2/2 Considering the fact that similarly situated co-accused Vivek Singh has already been granted regular bail by a coordinate Bench of this Court, let the above named petitioner be released on regular bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Kalyanpur P.S.Case No.156 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner and also that the petitioner shall not leave the country without permission of the Court.
