JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 40 of 2019 arising out of Tariyani Chowk P.S. Case No.176 of 2018 for the offenses under 302/34 of the Indian Penal Code.
The petitioner is suspected to be involved in the killing of the daughter of the informant.
Learned counsel appearing on behalf of the petitioner would submit that the petitioner is in custody since 16.11.2018 in case where the petitioner was not named in the FIR and he has not been put on TIP as yet. The petitioner has no criminal antecedent.
Considering the fact that the petitioner has no criminal

No.84808 of 2019(4) dt.04-06-2020 2/2 antecedent and he has remained in custody since 16.11.2018 in a case where there is no definite material to connect the petitioner in commission of the crime, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the District and Sessions Judge, Sheohar in connection with Sessions Trial No. 40 of 2019 arising out of Tariyani Chowk P.S. Case No.176 of 2018, subject to the condition that on release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of two months. He is required to report to the Civil Surgeon/ Nodal Officer, Covid-19, Sheohar, who shall utilize his services appropriately.
