The petitioner seeks bail in connection with Patliputra P.S. Case No. 544 of 2018, registered under Sections 394, 307 and 302 of the Indian Penal Code and 27 of the Arms Act. Submission is that it would appear from the first information report that on the basis of the fardbeyan of the informant, Ajay Kumar Mishra, Patliputra P.S. Case No. 544 of 2018 was instituted on 18.11.2018 against unknown and later on Section 302 of the Indian Penal Code was also added after the death of Ankit Kumar. In course of the investigation confessional statement of the co-accused, Sunil Kumar, was recorded, who confessed his guilt and disclosed the name of the
Patna High Court CR. MISC. No.802 of 2020(2) dt.21-01-2020 2/2 petitioner as his associate, indulged in the occurrence. The petitioner is in custody since 03.09.2019. In fact, the petitioner is accused in three cases, as detailed in paragraph 3, due to that reason the police managed to implicate in this case. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Patliputra P.S. Case No. 544 of 2018 to the satisfaction of Sri Ratneshwar Kumar Singh, Additional Sessions Judge, XII, Patna.
