The petitioners apprehend their arrest in connection with Bakhri P.S. Case No. 332 of 2019 registered for the offences punishable under Sections 188, 341, 323, 342, 504, 506/34 of the Indian Penal Code and Section 37 (b) (c) of Bihar Prohibition and Excise Act, 2016.
The prosecution story as contained in First Information Report is that on 16.10.2019, informant Arvind Kuamr Singh has been learnt that all the F.I.R. named accused persons in his land appertaining to Khata No.587, Khesara No.2118, area 1 bigha 7 khata has been constructed wall forcibly armed with deadly weapons. Informant when reached there saw that the accused persons constructed wall on protest
Patna High Court CR. MISC. No.84803 of 2019(2) dt.14-02-2020 2/2 accused Kari Mahto has been entered pistol into his mouth and ask to kill. Thereafter, all the accused persons assaulted him with fists and slaps. One Mohid Khalifa has been administered them wine and doing the said illegal work. On the alleged land, Section 144 of Cr.P.C. proceeding has been going on. Learned counsel for the petitioners submits that the petitioners have committed no offence. Admittedly, the petitioners were neither selling the liquor nor drinking the liquor.
In the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge cum Special Judge, Excise Act, Begusarai in connection with Bakhri P.S. Case No. 332 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Nasimul/- U T
