The petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

The informant recorded his fardbeyan before the S.I. of Alamganj Police Station that his brother had gone to participate in a marriage ceremony of a relative. He got information from a relative that his body was lying on the road and when he reached there he found that the blood was oozing from his stomach and it seems that he has been murdered by restoring firing upon him.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been

No incriminating article has been recovered from his conscious physical possession. He was not arrested on the spot. He has been remanded in this case by the police from another case on the confessional statement of one co-accused Vikash Kumar @ Kanapa and the said Viaksh Kumar has been granted bail by the learned Sessions Judge. He has been languishing in custody since 02.09.2019. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Patna City, Patna in connection with Alamganj P.S. Case No.280 of 2019.
